What Should I Do If I Get Pulled Over?

If you get pulled over, arrested, or questioned by the police there are several steps you should take to decreased the likelihood that you will be charged and convicted of a crime.

Be Polite: You should be polite and have your driver’s license and proof of insurance ready for the police officer.

The Right To Remain Silent: You should ask for the reason you are being stopped. If the officer begins to ask questions about drinking alcohol, speeding, etc you have the right not to answer questions and you should use that right. Any type of admission will increase the likelihood that you will end up arrested or ticketed and will end up written down as evidence against you in the police report. You should respectfully explain that you are going to use your right to not answer questions and ask the officer to write your traffic ticket so that you can leave.

The Right to Refuse Searches: Unless a police officer has probable cause or a warrant, they cannot legally search you or your vehicle without permission. If an officer asks you if they can search you or your vehicle, politely decline. If they search your vehicle illegally, do not try to stop them, this could lead to serious additional charges.

Comply With Lawful Orders: Comply with the officer. If they do something illegal, the time to fight it is in the courts, not the street. Keep your hands visible at all times, and don’t make any sudden movements. It is a good idea if the officer asks for something such as your ID to tell them where you will be going. For example, if your insurance card is in your glove box, and the office asks for it, you should say something like “My card is in my glove box. Would you like me to get it now?”
