Failure to Yield to Emergency Vehicle Laws in Missouri

Failing to yield to emergency vehicles: What you need to know…
Everybody probably understands that drivers are required to move over to the right as far as possible when an emergency vehicle is approaching with lights and sirens activated.

A little less known rule of law is RSMo 304.022.2(1)&(2):

When approaching a stationary emergency vehicle with lights activated, for example, a police officer 👮‍♀️ parked on the side of a highway writing a ticket 🚓 every driver must:
  • Proceed with caution and yield the right-of-way, if possible with due regard to safety and traffic conditions, BY MAKING A LANE CHANGE into a lane not adjacent to that of the stationary vehicle, if on a roadway having at least four lanes with not less than two lanes proceeding in the same direction as the approaching vehicle; or
  • Proceed with due caution and reduce the speed of the vehicle, maintaining a safe speed for road conditions, if changing lanes would be unsafe or impossible.
So basically, clear a lane between you and emergency vehicle unless it cannot be safely done, in which case you need to SLOW DOWN considerably and safely!
